Abell Auction Company – Conditions of Sale

Abell Auction Company, established in 1916, is committed to conducting auctions with transparency, professionalism, and consistency. The following Conditions of Sale are intended to ensure a fair and reliable experience for all bidders and buyers.

By registering to bid and participating in any Abell auction, you agree to the terms outlined below.


Condition of Property

All property is sold “as is” and “where is,” with all faults. While Abell makes reasonable efforts to provide accurate descriptions, including condition reports and photographs, all statements are opinions and should not be relied upon as guarantees.

Prospective bidders are strongly encouraged to inspect property in person or request additional information prior to bidding. The absence of a condition report does not imply that a lot is free from defects, restorations, or wear consistent with age and use.

Neither Abell nor its staff are responsible for errors or omissions in descriptions, whether oral or written.

All sales are final.


Bidding

Bidders are responsible for placing bids carefully and for understanding these Conditions of Sale prior to participating. By placing a bid, you acknowledge that you have had the opportunity to review all available information and to make independent determinations regarding condition and value.

Abell reserves the right to reject any bid, withdraw any lot, or cancel a sale at its discretion.


Payment

Payment is due immediately upon receipt of invoice unless otherwise specified.

Abell accepts payment by cash, check, or wire transfer. Credit card payments may be accepted in certain circumstances and are subject to a 3% convenience fee.

For purchases made through third-party platforms, payment may be required directly through that platform in accordance with its terms.

All purchases are subject to applicable sales tax unless a valid resale certificate or appropriate documentation is provided.

Title to property passes to the buyer upon full payment.


Non-Payment

If a buyer fails to make payment when due, Abell reserves the right to cancel the sale, resell the property, and hold the buyer responsible for any deficiency, including any costs, fees, or commissions associated with the resale.

Abell may also charge the buyer for any damages resulting from non-payment and reserves the right to restrict or revoke future bidding privileges.


Buyer’s Premium

A buyer’s premium will be added to the hammer price of each lot. The applicable rate may vary depending on the platform through which the bid is placed and will be clearly disclosed prior to bidding.


Shipping and Collection

Buyers are responsible for the collection or shipment of all purchased property.

Abell may offer in-house shipping on select items. When available, buyers will be contacted after payment to arrange shipping. For items not eligible for in-house shipping, buyers may arrange collection or coordinate shipment through a third-party provider. A list of recommended shippers is available on our website.

Property released to a third-party shipper must be accompanied by a valid bill of lading. Absent such documentation, applicable sales tax may be charged.

Abell is not responsible for loss or damage to property once it has been released to a shipper or third party.

All items must be removed within seven (7) days of the auction unless prior arrangements have been made.


Storage and Abandonment

Items not collected within seven (7) days may be subject to storage fees of the greater of $25 per lot per day or 10% of the purchase price per item, plus a $75 handling fee.

Items remaining uncollected after twenty-one (21) days may be deemed abandoned and may be resold at Abell’s discretion. Any costs associated with storage, handling, and resale will remain the responsibility of the buyer.


Risk of Loss

Risk of loss transfers to the buyer upon the fall of the hammer. Buyers are responsible for insuring their purchases immediately.


Limitation of Liability

Abell shall not be liable for any damages, including but not limited to incidental or consequential damages, arising from the purchase or use of any property.

In all cases, Abell’s liability, if any, shall not exceed the purchase price paid for the lot.


Disputes and Governing Law

Any disputes arising from these Conditions of Sale or from participation in an Abell auction shall be governed by the laws of the State of California.

By participating in the auction, bidders agree to resolve disputes through binding arbitration in Los Angeles County, California.


Changes to Terms

Abell Auction Company reserves the right to update or revise these Conditions of Sale at any time. Any changes will be effective upon posting and will apply to all subsequent use of our services. Continued participation in Abell auctions following such updates constitutes acceptance of the revised terms.


Final Acknowledgment

By registering to bid and participating in an Abell auction, you acknowledge that you have read, understood, and agreed to these Conditions of Sale.
